Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Notice (the “CHD Notice”) supplements Recor Medical Inc.’s Privacy Policy (“Privacy Policy”) and applies to Personal Information defined as “consumer health data” (“Consumer Health Data”) subject to Washington’s and Nevada’s consumer health data statutes (the “Consumer Health Data Laws”).

 

CONSUMER HEALTH DATA WE COLLECT

The Consumer Health Data we collect about you may vary depending on how you interact with us and the consents you may provide.  We may collect the following categories of Consumer Health Data:

  • Information about your health-related conditions or status, treatments, diseases or diagnoses; diagnostic testing, health measurements, symptoms, and medications.
  • Other information to the extent we use that information to infer or derive data related to the above or other health information.

 

SOURCES OF CONSUMER HEALTH DATA

As described further in the Sources of Information section of our Privacy Policy, we collect Personal Information (which may include Consumer Health Data) directly and indirectly from you, including through your use of features on this site, automatically from you via your interactions with this site (the “Site”), using cookies and other tracking technologies, from our subsidiaries, and from service providers, contractors, and third parties. We may infer certain information about you based on information provided from any of the sources listed above.

 

PURPOSE OF COLLECTION AND USE

We may collect, use, and process Consumer Health Data for the following purposes:

  • To provide information and communicate with you, such as responding to your questions and comments when you communicate with us and providing you with other information that may be of interest to you;
  • To provide, improve, and develop our products and services and market, promote, sell, and advertise them to you;
  • To personalize your experiences with us, including providing personalized and targeted advertising;
  • For business purposes, including to perform business analyses, and operate and improve our business and business activities; to help prevent and detect, and respond to security incidents, identity theft, fraud and any activity that is illegal; to address violations of law or other misuse of the Site or our products and services, and for any other business purpose permitted by law; and
  • For legal and safety purposes, including to comply with our legal and regulatory obligations, which arise from time to time, to protect our or other’s rights, privacy, safety or property, and/or that of our affiliates; to maintain the security of our customers, employees, and property, and to pursue remedies available to us and limit our damages.

We may combine or aggregate any Consumer Health Data for any of these purposes.  We may also de-identify and/or anonymize your Consumer Health Data in such a way that you may not reasonably be re-identified by us or any other organization and may use such de-identified or anonymized information for any purpose.

 

For certain purposes, we give you choices and/or obtain your consent as required by applicable law – for example, to use your Consumer Health Data for advertising or marketing purposes.

 

OUR SHARING OF CONSUMER HEALTH DATA

We may share each of the categories of Consumer Health data described above for the purposes described in this CHD Policy to our service providers and contractors for the purposes described above and, to the extent required, with your consent.

 

We are required to describe certain disclosures of Consumer Health Data as “sales” where we receive valuable consideration. No money is paid in exchange for your Consumer Health Data. Where applicable, we may share Consumer Health Data with the following categories of third parties with your consent to the extent required by law:

  • With business partners, such as ad networks or social media entities, for analytical purposes or who may deliver marketing communications, promotional materials, or advertisements that may be of interest to you. These business partners may engage in cross-contextual behavioral advertising on our behalf;
  • With our subsidiaries, who may deliver marketing communications, promotion material, or advertisements that may be of interest to you; and

 

Additionally, we may disclose and may disclose in the future each of the above-listed categories of Consumer Health Data to third parties:

  • Upon your request or approval, though we may not be able to accommodate all requests.
  • As reasonably necessary to facilitate a merger, acquisition, sale, joint venture or collaboration, reorganization, divestiture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings), or other types of strategic business transactions.
  • To law enforcement, government entities, including regulatory agencies and courts, as reasonably necessary for our business operational purposes, to assert and defend legal claims, and otherwise as permitted or required by law.

 

CONSUMER HEALTH DATA RIGHTS

We offer certain privacy rights regarding your Consumer Health Data as stated below, subject to certain limitations at law.

 

Right to Confirm Processing of Consumer Health DataThe right to confirm if we are collecting, sharing, or selling Consumer Health Data concerning you.
Right to Access Consumer Health DataThe right to access your Consumer Health Data, including a list of all third parties and subsidiaries with whom we have shared or sold the Consumer Health Data.
Right to Withdraw Consent to Collect and Share Consumer Health DataThe right to withdraw consent from our further collection or sharing of Consumer Health Data concerning you.
Right to Delete Consumer Health DataThe right to request deletion of the Consumer Health Data concerning you.

 

HOW TO EXERCISE YOUR PRIVACY RIGHTS

If you have consented to any cookies pursuant to our cookie banner, you can exercise the right to Withdraw Consent to collection through the use of cookies other than for strictly necessary cookies by accessing the Cookie Preference Center on our Sites, which you may access via our cookie banner or by clicking on a floated and persistent icon that appears on our Sites

 

You can exercise your other privacy choice rights regarding Consumer Health Data by completing this webform or call us at 1-888-914-9661 (PIN 347535).

 

We may need to authenticate your identity and request before processing it, which may require us to obtain additional Personal Information from you. We may use a third party to authenticate your identity. If you do not provide this information, we may not be able to verify or complete your request in all circumstances.

 

Any withdrawal of consent does not affect the use of your Consumer Health Data to the extent necessary to provide a product or service that that you have requested from us, including related transactional emails.

 

SUPPLEMENT FOR NEVADA RESIDENTS

This Supplement provides disclosures, in addition to those provided in our CHD Policy, that are applicable to Nevada residents under Nevada’s Consumer Health Data Law. For more information applicable to Nevada residents about our processing of Consumer Health Data, please see our CHD Policy.

 

RIGHT TO APPEAL

In certain circumstances, we may decline a request to exercise the rights described above in accordance with applicable law. If your request is denied, we will provide an explanation for the denial and instructions on how you may appeal a denied request. If your appeal is unsuccessful, Nevada residents can raise a concern or lodge a complaint with the Nevada State Attorney General at https://ag.nv.gov/Complaints/File_Complaint/

 

THIRD-PARTY COLLECTION OF CONSUMER HEALTH DATA

Please note that some third parties may collect Consumer Health Data about you over time and across different websites or online services you may visit.

 

CHANGES TO OUR CHD POLICY AND THIS SUPPLEMENT

We may make changes to our CHD Policy and to this Supplement from time to time, and we will notify you of such changes by posting an updated version of our CHD Policy and this Supplement, as applicable, on the Site.
